The time has come. I need to be at the Durban Magistrates Court in 45 minutes.
An interesting aside to this whole situation was brought up by my attorney yesterday when we were going over all the details once more - he seemed to recall that in the event of someone making a claim to their insurance in order to settle third-party losses, not their own losses, one has up to a year or so in which to make the claim. The 60-day policy which Dial Direct used to reject my claim should only have applied to me making a claim for my own damages, but they should have entertained the third party claim after that.
I shall investigate further. My attorney has recommended that if this is the case, I should write to the Insurance Ombudsman.

We got to court, and the other attorney asked if we wanted to settle. So my attorney asked what figure he had in mind. He said R5000. Totally unacceptable. So since they've conceded that I'm not liable for the entire damage, now all that remains is to haggle over how much I should pay. Which will require both sides producing experts who will say what damage was caused and how much it would cost to repair. Meaning that it's adjourned for now... probably till mid-year next year.
